Terms and Conditions of Service

These Terms and Conditions govern the provision of Clinical Solution Focused Hypnotherapy services by Samantha Welstead.

1. Introduction

These Terms and Conditions govern the provision of Clinical Solution Focused Hypnotherapy services by Samantha Welstead ("the Therapist", "I", "me", "my").

By booking, attending, or participating in any consultation, assessment, hypnotherapy session, online session, or receiving any hypnosis recordings, you agree to these Terms and Conditions.

2. Nature of Clinical Solution Focused Hypnotherapy

Clinical Solution Focused Hypnotherapy combines modern neuroscience, solution-focused therapeutic techniques, and hypnosis to help clients achieve positive change.

Hypnotherapy is a complementary therapy and is not intended to diagnose, treat, cure, or prevent any medical condition.

Clients should continue taking prescribed medication and following medical advice unless advised otherwise by their GP, Consultant, or other appropriately qualified healthcare professional.

Hypnotherapy outcomes vary between individuals, and no guarantee of results can be given.

3. Client Suitability

Clinical Solution Focused Hypnotherapy may not be suitable for everyone.

The Therapist reserves the right to:

  • Decline treatment.
  • Suspend treatment.
  • Request medical clearance from a GP or Consultant.
  • Refer clients to another appropriately qualified professional.

The Therapist may discontinue treatment if it is deemed inappropriate, unsafe, or outside the scope of professional competence.

4. Client Responsibilities

Clients agree to:

  • Provide accurate and honest information.
  • Disclose any relevant medical diagnoses, medications, or mental health conditions.
  • Inform the Therapist of any changes to their health or medication.
  • Attend sessions sober and free from the influence of alcohol or recreational drugs.
  • Participate fully in the therapeutic process.
  • Complete any agreed exercises or activities between sessions where appropriate.

Failure to provide accurate information may affect the effectiveness and safety of treatment.

5. Confidentiality

All information shared during therapy sessions will be treated as confidential.

Confidential information may be disclosed without consent where:

  • There is a serious risk of harm to the client or another person.
  • There are safeguarding concerns involving a child or vulnerable adult.
  • Disclosure is required by law.
  • Disclosure is ordered by a court.
  • Information is discussed anonymously within professional supervision.

Professional supervision forms part of ethical practice and helps maintain high standards of client care.

6. Fees and Payment

Session fees are communicated prior to booking and may be amended from time to time.

Payment is due:

  • At the time of booking; or prior to the session.
  • On the day of the appointment, as agreed, if payment is cash.

Accepted payment methods include bank transfer, cash, or other methods specified by the Therapist.

Outstanding balances must be settled before further appointments are provided.

7. Cancellation and Missed Appointments

A minimum of 72 hours' notice is required to cancel or rearrange an appointment.

Where less than 72 hours' notice is given:

  • The full session fee may be charged.

Failure to attend an appointment without notice will result in the full session fee becoming payable.

Exceptional circumstances may be considered at the Therapist's discretion.

8. Late Attendance

Appointments will end at the scheduled time.

Late arrival may reduce the available session time and does not entitle the client to a fee reduction or extended appointment.

9. Online Sessions

For online appointments, clients are responsible for:

  • Providing a suitable device.
  • Ensuring a stable internet connection.
  • Being located in a private and safe environment.
  • Ensuring they will not be interrupted during the session.

The Therapist cannot be held responsible for technical failures outside their control.

Should technical difficulties occur, reasonable efforts will be made to reconnect and continue the session.

10. Online Hypnosis Safety

Clients agree that during online hypnosis sessions they will:

  • Be seated comfortably or lying safely.
  • Not drive or operate machinery.
  • Not participate while responsible for supervising children or vulnerable individuals.
  • Ensure they are in a safe environment free from interruption.

11. Hypnosis Recordings

Any recordings provided remain the intellectual property of the Therapist.

Recordings are supplied for personal use only and must not be:

  • Shared.
  • Distributed.
  • Copied.
  • Sold.
  • Published.

Clients must never listen to hypnosis recordings while driving or operating machinery.

12. Results and Outcomes

The Therapist will provide services with reasonable care, skill, and professionalism.

No guarantee is given regarding:

  • Specific outcomes.
  • Speed of progress.
  • Number of sessions required.
  • Long-term maintenance of results.

Successful outcomes depend upon multiple factors, including client engagement and commitment.

13. Medical and Mental Health Conditions

Clients must inform the Therapist of:

  • Any psychiatric diagnosis.
  • Current mental health treatment.
  • Medication changes.
  • Neurological conditions.
  • Epilepsy.
  • Pregnancy where relevant.
  • Significant medical conditions.

The Therapist reserves the right to request written confirmation from a healthcare professional that hypnotherapy is appropriate.

14. Safeguarding

The safety and wellbeing of clients remain paramount.

Where safeguarding concerns arise regarding a child, young person, or vulnerable adult, the Therapist may take appropriate action in accordance with safeguarding legislation and professional obligations.

15. Data Protection and Privacy

Personal information is processed in accordance with UK GDPR and the Data Protection Act 2018.

Information collected may include:

  • Contact details.
  • Medical information.
  • Session notes.
  • Assessment information.
  • Appointment records.

Information is held securely and only retained for as long as necessary to meet legal, insurance, professional, and regulatory requirements.

Clients may request access to their personal data in accordance with UK GDPR legislation.

16. Professional Standards

The Therapist agrees to:

  • Work within professional competence.
  • Maintain appropriate professional indemnity insurance.
  • Undertake continuing professional development.
  • Follow the Code of Ethics and Practice of their professional association.
  • Maintain professional boundaries at all times.

17. Complaints Procedure

If a client is dissatisfied with any aspect of the service, concerns should be raised directly with the Therapist in writing.

Every effort will be made to resolve complaints promptly and professionally.

If resolution cannot be achieved, clients may contact the Therapist's professional association where applicable.

18. Limitation of Liability

Nothing in these Terms excludes liability where such exclusion would be unlawful.

Subject to applicable law, the Therapist's liability shall be limited to the value of the services provided.

The Therapist shall not be liable for indirect, consequential, or financial losses arising from decisions made by clients during or following therapy.

19. Consent

By booking or attending sessions, clients confirm that:

  • They understand the nature of Clinical Solution Focused Hypnotherapy.
  • They have had the opportunity to ask questions.
  • They voluntarily consent to treatment.
  • They understand they may stop a session at any time.
  • They have read and accepted these Terms and Conditions.

20. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
